Application of minimum wage legislation in the European Union

The right to apply provisions related to minimum wage by the Member States of the European Union results from:

  • Directive on the posting of workers in the framework of the provision of services No 96/71 / EC;
  • Directive 2014/67 / EU on the enforcement of Directive 96/71 / EC;
  • Jurisprudence of the European Court of Justice.

The entry into force of the aforementioned regulations results in the need to verify whether drivers working in the European Union (countries i.e. as Germany and France), excluding transit passes, receive a compensation of not less than what is required under the local regulations of each Member State. The new regulations impose also the need to comply with the provisions concerning the appointment of an Employer’s representative in the territory of Member State (i.e. France) as well as the need of keeping by a driver documents confirming the fact of receiving the minimum wage and other documents required by the foreign auditing authorities.

Scope of basic services

  • Running payroll for drivers working in international transport services;
  • Calculation of allowances resulting from the requirement of minimum wage in Member States of the European Union;
  • Preparation of appropriate documents confirming the amount of allowance due in order to reach the minimum wage in case of each driver.

  • Submitting a notification of driver’s entry to an EU Member State in accordance with applicable regulations (i.e. Germany and/or France)
  • Appointing a representative of the employer in the Member State (i.e.France);
  • Assistance in the preparation of documents and statements required by foreign audit authorities in relation of minimum wage requirements;
  • Participation in audits carried out by local authorities;
  • Application for A1 form – confirmation of the Polish social security system for each driver;
