Poland’s presidential veto: what it means for employing Ukrainian nationals (Update – 26 August 2025)
The President vetoed the latest amendment to the “special act” on assistance to Ukrainian citizens.
Temporary protection under EU law remains in force until 4 March 2027 – individuals with UKR status keep the right to stay and work in Poland.
The notification-based hiring route for Ukrainian citizens remains available, provided the person holds a valid residence title in Poland.
The main risk concerns a narrow group relying only on extended visas, extended residence cards, or visa-free stay. They should file residence applications promptly.
What stays the same (for now)
Right to stay & work under EU Temporary Protection: Poland remains bound by the EU Council decision through 4 March 2027. Holders of UKR status retain full access to lawful stay and employment.
Simple employer notification still works: Employing a Ukrainian citizen via notification of entrusting work continues to be possible, as long as the individual has a valid right for legal stay in Poland.
Who may face risk if Polish rules are not amended
A limited group could lose a lawful stay – and thus the right to work – if no Polish amendment is passed:
Ukrainians staying in Poland only on extended visas or,
extended residence cards or,
under visa-free regime.
President’s draft proposal at a glance
Compared with the bill previously adopted by Parliament, the presidential draft signals three notable shifts:
Ending the suspension of administrative deadlines in foreigners’ cases (and dropping plans to introduce new suspensions in protection matters),
Raising continuous-stay for citizenship eligibility from 3 to 10 years for holders of permanent residence, EU long-term residence or permanent EU right of residence (a change already debated publicly and likely to draw scrutiny),
Narrowing access to certain medical and family benefits to those who are economically active.
